| Breach of Contract — Long Term Coal Supply Contract |
We were retained by a major utility company to assist with the damages analysis related to a long term coal supply contract dispute.
The coal company had allegedly been supplying less than contract specification coal (lower Btu quality and higher
sulfur content) for over 15 years. We created damage models which depicted the effect that the lower quality coal had
on operations of the affected power plants. We quantified lost generation, increased down time, increased maintenance, replacement
power and other related damages allegedly caused by the breach of contract. We also reviewed and critiqued the
coal company's counter claims. We coordinated with numerous coal, combustion, boiler equipment and operation experts.
Finally we provided expert testimony related to damages.
