We were retained by a large candy manufacturer to determine
the economic harm resulting from a defect in the candy wrappers
supplied by their paper manufacturer. After a latency period, the wrappers obtained an odor similar to burnt crayons.
By the time the defect became apparent, six months of product had been produced, distributed and sold across the country.
Damages included the determination of lost profits resulting from the negative impact in the marketplace, in addition to product recall costs.
We provided expert testimony and this matter settled favorably after the deposition phase.
